These Terms of Service ("Terms") are a binding agreement between you and Habitgram LLC ("Habitgram," "we," "us," or "our") governing your use of the Habitgram mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate. The Service includes community, messaging, and user-generated-content features; if you are a minor, you may use the Service only with the involvement of a parent or guardian where required by law.
You are responsible for your account and for keeping your credentials secure. You may sign up with an email and password or through Sign in with Google or Sign in with Apple. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use.
The Service offers auto-renewing subscriptions. On iOS, all purchases and renewals are processed by Apple through the App Store / Apple In-App Purchase, and are subject to the Apple Media Services / App Store terms in addition to these Terms.
We currently offer two auto-renewing subscription tiers:

Prices are in U.S. dollars and may vary by region and over time. The price, billing period, and tier shown to you at the point of purchase in the App Store govern your purchase. A free trial may be offered; if a trial is offered and you do not cancel before it ends, your subscription converts to a paid auto-renewing subscription at the then-current price.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for your plan.
You can manage or cancel your subscription, and turn off auto-renewal, at any time through your Apple account settings (Settings → your name → Subscriptions on iOS). Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
Purchases made through Apple are subject to Apple's refund policies; we generally cannot grant refunds for App Store purchases directly. Except where required by law, payments are non-refundable.
If you subscribe through our website rather than the App Store, billing is handled by our payment processor (Stripe) and the same auto-renewal and cancellation principles apply through that channel.
We may change subscription pricing or plan features. We will provide notice as required, and changes to recurring prices will apply to subsequent billing periods; you may cancel before a change takes effect.
The Service lets you create content and interact with others (including Tribes, the social feed, comments, and direct messages). You retain responsibility for everything you post or send.
Habitgram is a personal-growth community intended to support people in pursuing their goals. We maintain a positive, supportive environment, and we may remove content or restrict accounts that undermine it, including objectionable content even where it is not specifically listed below.
You agree not to post, send, or share content, or engage in conduct, that:
We have zero tolerance for objectionable content and abusive users. We may remove content and suspend or terminate accounts that violate these rules.
We aim to review reports of objectionable content promptly and take appropriate action, which may include removing content and removing the offending user, consistent with our policies.
You own the content you create. We do not claim ownership of your habits, journals, vision boards, manifestations, affirmations, journeys, messages, posts, or uploaded media.
To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt (e.g. format and generate audio), and display your content solely to provide and improve the Service and as directed by your sharing/visibility settings. For community content you choose to share, this license extends to displaying that content to the users you share it with. This license ends when you delete your content or your account, except for content others have already shared or copied, content retained in backups for a limited period, or as required by law.
You are responsible for ensuring you have the rights to any content you upload, including images, audio, and video.
Some features generate content using artificial intelligence and require sending your inputs to third-party AI providers, as described in the Privacy Policy. AI-generated content may be inaccurate or unsuitable; it is provided for personal motivation and reflection and is not professional, medical, psychological, financial, or legal advice. Use your own judgment.
The Service is a self-improvement and habit-tracking tool. It does not provide medical, mental-health, or professional advice and is not a substitute for professional care. If you are experiencing a crisis or need help, contact a qualified professional or emergency services. Never disregard professional advice because of something in the Service.
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or legal exposure for us, or for any lawful reason. Upon termination, your right to use the Service ends; sections that by their nature should survive (including content license terms already granted to others, disclaimers, limitation of liability, and governing law) survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITGRAM LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Habitgram LLC from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. The parties submit to the jurisdiction of the state and federal courts located in Utah, except where applicable law provides otherwise.
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
These Terms are between you and Habitgram LLC only, not with Apple. Apple is not responsible for the Service or its content. To the extent the Service is acquired through the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
